Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and ilovemypets.ai ("ilovemypets.ai," "we," "us," "our") governing your use of our website, web application, and mobile applications (together, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and able to form a binding contract.

2. The Service

The Service uses artificial intelligence to generate media — such as "talking pet" videos, images, audio, and interactive "call" experiences — from photos and inputs you provide. Results are generated automatically and may vary in quality and accuracy.

3. Your Content and the Rights You Grant

  • "User Content" means the photos, text, and other materials you upload or submit.
  • You retain ownership of your User Content.
  • You grant us a limited, worldwide, non-exclusive license to host, store, process, transmit to our AI providers, and modify your User Content solely to operate and provide the Service to you (including generating your requested outputs). This license ends when you delete the content or your account, except for residual backup copies and content we must retain for legal reasons.

3.1 Your responsibilities for uploads

You represent and warrant that:

  • You own or have all necessary rights to the photos and content you upload;
  • If you upload a photo containing another person, you have that person's consent to use their image in the Service. You will not upload images of any person without their permission, and you will not upload images of minors;
  • Your User Content does not infringe any third party's intellectual-property, privacy, or publicity rights, and does not violate any law.

You are solely responsible for your User Content and for obtaining any consents required.

4. Generated Output

  • Subject to your compliance with these Terms, we assign to you such rights as we hold in the specific media the Service generates for you, for your personal and lawful use.
  • AI output is provided "as is." It may contain inaccuracies or artifacts and may not resemble the subject as you expect. We make no guarantee about the likeness, accuracy, or quality of generated media.
  • Similar or identical outputs may be generated for other users from similar inputs; we make no exclusivity guarantee over styles, templates, or common results.

5. Acceptable Use

You agree not to use the Service to create, upload, or share content that:

  • Depicts or sexualizes minors in any way;
  • Uses another real person's likeness without consent, or creates misleading or defamatory depictions of real people;
  • Is sexual, violent, hateful, harassing, or promotes illegal activity;
  • Infringes intellectual-property, privacy, or publicity rights;
  • Impersonates others or is intended to deceive, defraud, or spread misinformation;
  • Attempts to reverse-engineer, scrape, overload, or circumvent the Service, its usage limits, or its safeguards.

We may remove content, and suspend or terminate accounts, that violate these rules. You can report content in-app; reports are reviewed and may be actioned.

6. Subscriptions, Treats, and Payments

6.1 Treats

The Service uses a virtual currency ("treats") to create media and to use interactive features such as calls. Treats have no monetary value, are not redeemable for cash, and are non-transferable. Treat costs per creation or per minute of use are shown in the app and may change.

6.2 Subscriptions and auto-renewal

  • Subscriptions (e.g., weekly and monthly plans) grant a recurring allotment of treats and renew automatically at the then-current price until cancelled.
  • An introductory price, where offered, applies only to the first billing period and is available once per user.
  • Payment is charged to your Apple, Google, or Stripe account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
  • Manage or cancel anytime through your App Store or Google Play account settings, or (for web purchases) as directed in the app. Deleting the app does not cancel a subscription.

6.3 Purchased treat packs

One-time treat packs may be offered to subscribers. Purchased treats do not expire while you maintain an account, but are non-refundable except as required by law or the applicable app-store policy.

6.4 Refunds

Purchases are generally non-refundable except where required by law or by Apple/Google/Stripe policies. App-store purchases are subject to the relevant store's refund process.

7. Intellectual Property

The Service, including its software, design, templates, trademarks, and content (excluding User Content and your generated outputs), is owned by us or our licensors and protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service. You may not copy, modify, distribute, or create derivative works except as expressly allowed.

8. Third-Party Services

The Service relies on third-party providers (including AI, hosting, payment, and analytics providers described in our Privacy Policy). We are not responsible for third-party services, and your use of app-store and payment services is also subject to their terms.

9. Disclaimers

THE SERVICE AND ALL GENERATED OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding the accuracy, quality, or likeness of generated media. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, we and our affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or of any law or third-party right — including any claim that a photo you uploaded was used without the necessary consent.

12. Termination

We may suspend or terminate your access at any time for violation of these Terms or to protect the Service or other users. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (e.g., ownership, disclaimers, limitation of liability, indemnification) will survive.

13. Governing Law and Disputes

If a dispute arises, please contact us first at support@ilovemypets.ai so we can try to resolve it directly. Any dispute relating to these Terms or the Service will be handled in accordance with applicable law.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, where required, notify you. Continued use after changes means you accept them.
